NOTICE OF PROPOSED VACATION (DISPOSAL) OF RIGHT OF WAY
NOTICE IS HEREBY GIVEN that the State of Alaska Department of Transportation and Public Facilities (the Department) proposes to vacate the Elliott Highway Fox Rest Area, Project No. LSS-0680(2). This roughly 2-acre parcel is located on the west side of the Elliott Highway at approximately MP 0.5, just northwest of Fox and the Steese Highway/Elliott Highway intersection, and is the site of the “Fox Spring Public Drinking Water System.” The property is legally described as portions of the NW ¼ NE ¼ and NE ¼ NW ¼, Section 31, T2N, R1E, FM
The Department has determined that the subject property is outside the roadway slope limits and is not needed for the roadway’s maintenance and/or operation. The parcel may be conveyed to another public agency or municipality, or may be sold to a private entity. If sold to a private entity, the purchase price will be the actual fair market value as determined by an independent appraisal.
The disposal of right of way by the Department is authorized by AS 19.05.070 and is guided procedurally under 17 AAC 10.100.
The physical file of the proposal is available for public inspection from 8:00 a.m. to 4:30 p.m., Monday through Friday, at the Department of Transportation and Public Facilities, Right of Way Section, 2720 Pickett Place (west side of Peger Road), Fairbanks, Alaska. The Department will accept and review public comments regarding the proposed vacation (file CQD # 15-02-002). Comments must be made in writing and must be received no later than 4:30 p.m. on Wednesday, July 15, 2015.
