Amendment Application for the Trans-Alaska Pipeline Right-of-Way Lease, ADL 63574

NOTICE OF RIGHT-OF-WAY AMENDMENT APPLICATION

The Commissioner of the Department of Natural Resources, pursuant to Alaska Statute (AS) 38.35.070, hereby gives notice that Alyeska Pipeline Service Co., as agent for the Trans-Alaska Pipeline System (TAPS) lessees, submitted a request on April 17, 2013, to amend the Right-of-Way Lease for the Trans-Alaska Pipeline System, ADL 63574, to add approximately 0.25 acres of land east of the Delta River, north of Suzy Q Creek.  The project area is approximately 39 miles south of Delta Junction, and east of the Richardson Highway. 

The additional land is needed for the installation of new Anodeflex, drilled magnesium rods, to improve cathodic protection along the buried mainline pipe in this area.  There will be a new Thermal Electric Generator (TEG) and a new below-ground 1,000-gallon propane tank placed on the site.  The TEG will be tied into the existing power module (6 ft. by 6 ft.), which will be relocated from over the top of the mainline pipe.  The power module, fuel tank, and TEG will be offset from the pipe centerline.  These upgrades are proposed in order protect the buried pipeline from corrosion.

The lands are generally described as:

NW4 Section 29, Township 16 South, Range 10 East, Fairbanks Meridian; within U.S. Survey 4386 immediately adjacent to and easterly of the Trans-Alaska Pipeline Right-of-Way, ADL 63574, comprising approximately 0.25 acres.

AS 38.35.200 governs judicial review of decisions of the commissioner:

            AS 38.35.200: Judicial review of decisions of commissioner on application.

(a) An applicant or competing applicant or a person who has direct financial interest affected by the lease who raises objections within 60 days of the publication of notice under AS 38.35.070 are the only persons with standing to seek judicial review of a decision of the commissioner under AS 38.35.100.

(b) The only grounds for judicial review of a decision of the commissioner are

(1) failure to follow the procedures set out in this chapter; or

(2) abuse of discretion so capricious, arbitrary, or confiscatory as to constitute a denial of due process.

Any objections pursuant to 38.35.200 must be submitted in writing to the address below by 5:00 p.m. on June 21, 2013.
