Notice of Filing of Petition for Legislative Review Annexation
to the City of Fairbanks

The City of Fairbanks, a home-rule city in the Fairbanks North Star Borough,
has filed an annexation petition with the Alaska Local Boundary Commission
(LBC). The territory proposed by the City for annexation consists of two
territories totaling approximately 0.05 square miles. The annexation would
increase the area of the City to approximately 33.85 square miles.
The area contemplated for annexation is generally described as follows: Fred
Meyer Subdivision (location of the Fred Meyer “West” store and businesses at
University Avenue and Airport Way) and the “Enclave” Lots on Park & Riverside
Drives, Bartlett Avenue, and Airport Access Road, a total of 0.05 square miles.
The legal description of the territory proposed for annexations is set out in
the Petition. A map of the area proposed for annexation is linked as an
attachment to this posting.

Standards governing the annexation to cities are established in article X
section 1, Constitution of the State of Alaska; AS 29.06.040 – 29.06.060; 3
AAC 110.090 – 3 AAC 110.150; and 3 AAC 110.900 – 3 AAC 110.990.

Procedures governing city annexation by the legislative-review method are set
out in article X, section 12 of Alaska’s Constitution, AS 29.06.040, 3 AAC
110.400 – 3 AAC 110.660, and 3 AAC 110.700.

Any interested person may file with the LBC written comments supporting or
opposing the annexation petition. Additionally, any person may file with the
LBC a responsive brief in support of or in opposition to the petition.
Responsive briefs must be filed in accordance with 3 AAC 110.480. A person who
files a responsive brief (as distinguished from written comments) gains certain
procedural rights and duties during the annexation proceedings. The deadline
for filing responsive briefs and written comments with the LBC is 4:30 p.m.,
April 17, 2009. Responsive briefs and written comments must be received in the

After the Petitioner has an opportunity to answer any responsive briefs and
comments, the Alaska Department of Commerce, Community, and Economic
Development (Commerce) will prepare a preliminary report on the proposal.
Following receipt of comment on the preliminary report, Commerce will issue
its final report. Procedures governing departmental reports are set out in 3
AAC 110.530. The LBC will then hold at least one local public hearing on the
proposal. If the LBC approves the petition, annexation will be subject to
legislative review pursuant to article X, section 12 of the Constitution of the
State of Alaska and AS 29.06.040(b).
