Notice of Proposed Regulation Changes: Commercial Vehicle Compliance, Department of Transportation and Public Facilities

NOTICE OF PROPOSED CHANGES ON COMMERCIAL VEHICLE COMPLIANCE IN THE REGULATIONS OF DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES

BRIEF DESCRIPTION

The Department of Transportation and Public Facilities proposes to update its commercial vehicle regulations to conform to current federal regulations.

The Department of Transportation and Public Facilities proposes to adopt regulation changes in Title 17 of the Alaska Administrative Code, dealing with commercial vehicle compliance, including the following:

  1. 17 AAC 25.012, which amends the National Highway System map website.

  2. 17 AAC 25.013, which amends the date range to match the Fairbanks North Winter Exception dates in the Permits Manual and adds the definition for covered heavy-duty tow and recovery vehicle.

  3. 17 AAC 25.014, which modifies language for truck tractor.

  4. 17 AAC 25.015, updating the Chapter 23 adopted by reference to April 1, 2021 version.

  5. 17 AAC 25.200, which adopts by reference federal regulations pertaining to the transportation of hazardous materials, hazardous substances, or hazardous waste, is proposed to adopt the March 15, 2023 version of those regulations.

  6. 17 AAC 25.210, which adopts by reference federal regulations pertaining to the safe operation of commercial motor vehicles, is proposed to adopt the March 15, 2023 version of those regulations and also amends the inspection report title.

  7. 17 AAC 25.220, which adopts by reference federal regulations pertaining to the hours of service for commercial vehicle drivers, is proposed to be changed to adopt the March 15, 2023 version of those regulations and also amends the inspection report title.

  8. 17 AAC 25.320, which pertains to permits for oversize or overweight vehicles, including adoption by reference of the Department’s Administrative Permit Manual: Oversize and Overweight Permits, is proposed to be changed by adopting the April 2023 version of this manual and modifies the language for overhanging loads for extended period permits.

  9. 17 AAC 25.400, which amends the Unified Carrier Registration website and stop movement order.

  10. 17 AAC 25.900, which aligns definitions for pole trailer, semitrailer, truck, and truck tractor to match the federal regulations.

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Carlos Rojas at 11900 Industry Way, Building M, Suite 2, Anchorage, Alaska 99515. Additionally, the Department of Transportation and Public Facilities will accept comments by facsimile at 907-365-1221 and by electronic mail at MSCVC.chapter25regs@alaska.gov. Comments may also be submitted through the Alaska Online Public Notice System, by accessing this notice on the system and using the comment link. The comments must be received not later than 5:00pm on November 8, 2023.

Oral or written comments also may be submitted at a hearing to be held on November 7, 2023 in the Conference Room, 11900 Industry Way, Building M Suite 2, Anchorage, Alaska 99515. The hearing will be held from 2:00pm to 4:00pm and might be extended to accommodate those present before 3:30pm who did not have an opportunity to comment.

You may submit written questions relevant to the proposed action to Carlos Rojas at 11900 Industry Way, Building M, Suite 2, Anchorage, Alaska 99515 or MSCVC.chapter25regs@alaska.gov. The questions must be received at least 10 days before the end of the public comment period. The Department of Transportation and Public Facilities will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System.

After the public comment period ends, the Department of Transportation and Public Facilities will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected.

Fiscal information: The proposed regulation changes are not expected to require an increased appropriation.
