NOTICE OF PROPOSED CHANGES ON SPECIFIED ANADROMOUS WATERS IN THE REGULATIONS OF THE DEPARTMENT OF FISH AND GAME

The Alaska Department of Fish and Game (ADF&G) proposes to adopt regulation changes in 5 AAC 95.011 of the Alaska Administrative Code, dealing with waters important for the spawning, rearing, or migration of anadromous fish, including the following:

5 AAC 95.011 is proposed to be changed as follows: updating the Atlas to the Catalog of Waters Important for the Spawning, Rearing, or Migration of Anadromous Fishes and Catalog of Waters Important for the Spawning, Rearing, or Migration of Anadromous Fishes (atlas and catalog), to adopt by reference the June 2024 revised edition.

The 2024 edition of the atlas and catalog provides updates to the list of rivers, lakes, and streams, including additions, deletions, and changes to legal descriptions. Minor revisions are made to the introduction of the catalog. Additionally, species-specific information is used in place of undifferentiated species information wherever possible.

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Scott Graziano, Alaska Department of Fish and Game – Habitat Section, 333 Raspberry Road, Anchorage, AK 99518. Additionally, the Alaska Department of Fish and Game will accept comments by facsimile at (907) 267-2499 and by electronic mail at dfg.hab.anadromous@alaska.gov. The comments must be received not later than 5:00 p.m. on April 18, 2024.

You may submit written questions relevant to the proposed action to Scott Graziano, Alaska Department of Fish and Game – Habitat Section, 333 Raspberry Road, Anchorage, AK 99518. The questions must be received at least 10 days before the end of the public comment period. The Alaska Department of Fish and Game will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and at the agency’s website at http://awc.adfg.alaska.gov.

The ADF&G offices located in Craig at Westwind Plaza – Suite 302, Craig, Alaska 99921; Delta Junction at 266.8 Richardson Hwy, Delta Junction, Alaska 99737; Douglas at 802 3rd Street, Douglas, Alaska 99824; Homer at 3298 Douglas Place, Homer, Alaska 99603; Ketchikan at 2030 Sealevel Drive – Suite 205, Ketchikan, Alaska 99901; Nome at 103 E. Front Street, Nome, Alaska 99762; and Soldotna at 43961 Kalifornsky Beach Road – Suite B, Soldotna, Alaska 99669; each have copies of the proposed changes and draft atlas maps only for the region that corresponds to that office.

After the public comment period ends, the Alaska Department of Fish and Game will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected.

Fiscal information: The proposed regulation changes are not expected to require an increased appropriation.
