NOTICE OF PROPOSED CHANGES IN THE REGULATIONS OF THE STATE BOARD OF REGISTRATION FOR ARCHITECTS, ENGINEERS, AND LAND SURVEYORS

Notice of proposed changes in the regulations of the State Board of Registration for Architects, Engineers, and Land Surveyors

Brief Description: The State Board of Registration for Architects, Engineers, and Land Surveyors proposes to update various regulations relating to applications for initial licensure and the respective requirements for work experience, professional or subprofessional experience, dates of experience, eligibility for examination, education requirements, supporting verification requirements; requirements for licensure by comity; standards and definitions

The State Board of Registration for Architects, Engineers, and Land Surveyors (Board) proposes to adopt regulation changes in Title 12, Chapter 36 of the Alaska Administrative Code including the following:

  1. 12 AAC 36.063 Engineering education and work experience requirements, is proposed to be changed as follows: to allow an applicant to use the experience gained through an eligible mentoring program in combination with traditional work experience to meet the application requirements for initial licensure as an engineer; to remove reference to structural engineering license by examination.
  2. 12 AAC 36.067. Dates of experience, is proposed to be amended by allowing an applicant for registration by examination to project up to three months of relevant experience while their application is pending Board approval.
  3. 12 AAC 36.075. Eligibility for Structural Engineering Registration by Examination, is a proposed new section outlining the requirements to obtain a structural engineering license by examination.
  4. 12 AAC 36.100. Required examinations, is proposed be amended by clarifying the requirement that an applicant for registration as a land surveyor must pass the NCEES Principles and Practice of Surveying examination whether applying by examination or by comity.
  5. 12 AAC 36.104. Structural Engineer Registration by Comity, is a proposed new section outlining the requirements for a structural engineering license by comity.
  6. 12 AAC 36.105. Engineer Registration by Comity, is proposed to remove reference to structural engineering comity requirements.
  7. 12 AAC 36.107. Land surveyor registration by comity, is proposed to amend the examination requirements for applicants for registration as a land surveyor by comity to reflect the changes in 12 AAC 36.100.
  8. 12 AAC 36.990, Definitions, is proposed to add a definition of “mentoring program”, remove references to structural engineering as a sub-branch of professional engineering and delete the definition of “progressive structural experience”.

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Alison Osborne, Regulations Specialist, Division of Corporations, Business and Professional Licensing, P.O. Box 110806, Juneau, AK  99811-0806. Additionally, the Board will accept comments by facsimile at (907) 465-2974 and by electronic mail at RegulationsAndPublicComment@alaska.gov . Comments may also be submitted through the Alaska Online Public Notice System by accessing this notice on the system at http://notice.alaska.gov/211440 , and using the comment link. The comments must be received not later than 4:30 p.m. on July 19, 2023. Comments received after this deadline will not be considered by the Board.

You may submit written questions relevant to the proposed action to Alison Osborne, Regulations Specialist, Division of Corporations, Business and Professional Licensing, P.O. Box 110806, Juneau, AK  99811-0806 or by e-mail at RegulationsAndPublicComment@alaska.gov. The questions must be received at least 10 days before the end of the public comment period. The Board will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and on the Board’s website at https://www.commerce.alaska.gov/web/cbpl/ProfessionalLicensing/BoardofArchitectsEngineersandLandSurveyors.aspx. The Board may, but is not required to, answer written questions received after the 10-day cut-off date and before the end of the comment period.

After the public comment period ends, the Board will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected. Written comments and questions received are public records and are subject to public inspection.
