Notice Of Proposed Changes On Room And Board Regulations

NOTICE OF PROPOSED CHANGES ON CHANGE TO ROOM AND BOARD IN THE REGULATIONS OF DEPARTMENT OF LABOR AND WORKFORCE DEVELOPMENT

The Department of Labor and Workforce Development proposes to adopt regulation changes in 8 AAC 15.160 of the Alaska Administrative Code, dealing with room and board regulations including the following:

  1. 8 AAC 15.160(d) is proposed to be changed to add a new paragraph stating when an employer can deduct from an employee’s earnings.

     

  2. 8 AAC 15.160(e) is amended to say that the employer cannot deduct the cost of room and board without providing a prior written notice to the employee.

     

  3. 8 AAC 15.160(f) is proposed to be changed to amend the cost of a deduction for board and lodging with regards to a determination.

     

  4. 8 AAC 15.160(h) is proposed to be amended to state that the employer shall provide a written of electronic statement of earnings and deductions for each pay period.

     

  5. 8 AAC 15.160 is amended by adding a new subsection (i) and (j) regarding an appeal of a determination.

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Theric Austin at 1251 Muldoon Road, Suite #109, Anchorage, AK 99504. Additionally, the Department of Labor and Workforce Development, Division of Labor Standards & Safety will accept comments by facsimile at 907-269-4950 and by electronic mail at dol.lss.regulations@alaska.gov. Comments may also be submitted through the Alaska Online Public Notice System by accessing this notice on the system and using the comment link. The comments must be received not later than 4:30pm on June 13th, 2023.

You may submit written questions relevant to the proposed action to Theric Austin at dol.lss.regulations@alaska.gov and 907-269-4957. The questions must be received at least 10 days before the end of the public comment period. The Department of Labor and Workforce Development, Division of Labor Standards & Safety will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System https://www.labor.alaska.gov/commish/regindex.htm.

After the public comment period ends, the Department of Labor and Workforce Development, Division of Labor Standards & Safety will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected. Written comments received are public records and are subject to public inspection.

Fiscal information: The proposed regulation changes are not expected to require an increased appropriation.
