NOTICE OF RIGHT-OF-WAY LEASE AMENDMENT REQUEST
RIGHT-OF-WAY LEASE FOR THE
ALASKA STAND ALONE GAS PIPELINE/ASAP

The Commissioner of the Department of Natural Resources (Commissioner), pursuant to Alaska Statute (AS) 38.35.070, hereby gives notice that the Alaska Gasline Development Corporation has submitted a request to amend the Right-of-Way (ROW) lease for the Alaska Stand Alone Pipeline Pipeline/ASAP.
The amendment request proposes several significant changes to the lease:

Addition of the Gas Conditioning Facility on the North Slope; approx. 91 acres.

Addition of roads, work pads, and other related facilities identified in the 2016 Mapbooks for future inclusion; approx. 119 acres.

Addition of material source areas identified in the 2016 Mapbooks for future inclusion; approx. 664 acres.
-
Addition of lands for project changes; approx. 199 acres.
The ROW lease is only applicable to state-owned lands managed by the Department of Natural Resources (DNR). It does not apply to privately owned lands.
The amendment request, line lists, links to various mapping programs, and other supporting documentation are available online: http://dog.dnr.alaska.gov/Home/Newsroom. The public may obtain hard copies of any of the documents, at cost, from the State Pipeline Coordinator’s Section (SPCS) upon request (see address below). Electronic copies of the documents are also available at the Anchorage, Wasilla, Fairbanks, and Barrow libraries.
AS 38.35.200 governs judicial review of a decision of the Commissioner:

An applicant or competing applicant or a person who has direct financial interest affected by the lease who raises objections within 60 days of the publication of notice under AS 38.35.070 are the only persons with standing to seek judicial review of a decision of the commissioner under AS 38.35.100.

The only grounds for judicial review of a decision of the commissioner are
-
failure to follow the procedures set out in this chapter; or
-
abuse of discretion so capricious, arbitrary, or confiscatory as to constitute a denial of due process.
Any objections pursuant to 38.35.200 must be submitted in writing to the address below by 5:00 p.m. on July 2, 2018. Submittals must include how the commenter has standing under AS 38.35.200(a). Please contact the SPCS with any inquiries.
