Public Access and Utility Easement
Previously Constructed Gravel Road

Proposed Project and Location:

In accordance with AS 38.05.850, the Department of Natural Resources, Division of Mining, Land and Water (DMLW) Southcentral Regional Office is considering the issuance of a public access and utility easement for a segment of previously constructed gravel road known as Tom Cat Road where it is situated on DNR managed lands within Section 21, Township 5 South, Range 12 West, Seward Meridian. The proposed easement will be approximately 917.54 feet long and 60 feet wide resulting in an overall area of 1.26 acres, more or less. The purpose of the easement is to facilitate surface upgrades (ditching, widening, embankment construction, etc.) by the Kenai Peninsula Borough. Please see the attachments for additional location information. Nothing herein implies the establishment of an easement across lands that are not managed by DNR, even if they are depicted on project-related maps, plans or drawings.

Comment Period and Additional Information:

Members of the public and interested parties are invited to comment on this proposal. The Division of Mining, Land and Water must received written comments addressed to DNR-DMLW Southcentral Regional Office, 550 W. 7th Avenue, Suite 900C, Anchorage, AK 99501-3577 no later than 5:00 pm on Friday, April 14, 2017. All comments should clearly explain the facts on which they are based and how they pertain to the proposed action. Following he comment deadline all responses will be reviewed and the Department's decision on the matter may be modified based on the responses received.
