PUBLIC NOTICE
AMENDMENT TO PERMIT & CERTIFICATE OF APPROPRIATION OF WATER, LAS 30043
Pursuant to AS 46.15 and 11 AAC 93, notice is hereby given that an amendment to Permit and Certificate of Appropriation of Water, LAS 30043 for Lake M9605 is occurring to address defects made in the determination and certificate by the Department at the time of issuance.
This amendment to the Permit & Certificate of Appropriation of Water, LAS 30043, will:
- Address the full comments received from ADF&G during the public notice, which were omitted from the original determination, and address the results of the recharge monitoring completed by the applicant, which was required in Fish Habitat Permit FH05-III-0328-Amendment 4 (a copy is included in the attached “2017_full ADF&G comments.pdf”).
- Clarify the amount of water authorized under ice in the winter vs withdrawals during ice free periods.
- Clarify that ice harvest is allowed from naturally grounded ice and the amount (in gallons) that can be taken, which was requested in the application, Statement of Beneficial Use and original public notice.
- Update the conditions in the certificate to the current standards for this type of use, a surface source with fish.
- Correct any errors in notification from the first agency notice and any discrepancies between the Public Interest Determination and the Review and Determination.
- Correct the area of appurtenance to what was requested by the applicant and public noticed (water use within 30 miles of the withdrawal location).
This amendment is only occurring to address errors made by DNR during the adjudication following the original public and agency notice. Please see the attached original public notice, comments received from ADF&G, determinations and current certificate.
Per AS 46.15.133 and 11 AAC 93.930(b), within 15 days of publication or service of notice, persons may file with the director written objections stating the name and address of the objector, and any facts tending to show that rights of the objector or the public interest would be adversely affected by the proposed amendment. Objections must be made in writing by email to lesli.schick@alaska.gov or by mail to the Alaska Department of Natural Resources, Water Resources Section, 550 W 7th Ave, Suite 1020, Anchorage, AK 99501-3562 on or before December 18, 2025. After public and agency input is considered, a decision will be issued without further public notice. A copy of the decision will be sent to any person who provided an objection or written comment.
