Notice of Proposed Changes on Landfill Monitoring in the Regulations of the Department of Environmental Conservation

Brief Description: The ADEC proposes to change regulations on landfill monitoring requirements to clarify intent, to conform the regulation to current technology and practice, and to provide better regulatory support for existing Solid Waste Program practices for landfill monitoring.

The Department of Environmental Conservation proposes to adopt regulation changes in Title 18, Chapter 60 of the Alaska Administrative Code, dealing with landfill visual, gas, and water monitoring, including the following:

 

  1. 18 AAC 60.350 is repealed and consolidated into 18 AAC 60.805.

     

  2. 18 AAC 60.800 is amended to remove air pollution monitoring and to address visual monitoring corrective action requirements.

     

  3. 18 AAC 60.805 is established to consolidate criteria for landfill gas and air monitoring.

     

  4. 18 AAC 60.810 is amended to define the requirements for surface water monitoring.

     

  5. 18 AAC 60.815 is repealed as visual monitoring corrective action and surface water monitoring corrective action are consolidated into other sections.

     

  6. 18 AAC 60.820 is amended to consolidate the general requirements for groundwater monitoring.

     

  7. 18 AAC 60.825 is amended to consolidate the requirements for installation and initial monitoring of groundwater monitoring systems.

     

  8. 18 AAC 60.830 is amended to consolidate the requirements for groundwater sampling and analysis, to eliminate repetition, and to reorganize and clarify sections that are confusing or convoluted.

     

  9. 18 AAC 60.840 is amended to establish the baseline constituents for groundwater monitoring and to establish criteria for adding constituents for groundwater monitoring.

     

  10. 18 AAC 60.850 is amended to clarify requirements of a detection monitoring program.

  11.  18 AAC 60.860 is amended to update the criteria for assessment monitoring and corrective action.

  12.  18 AAC 60.990 is amended to modify and repeal definitions.

 

 

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to Rebecca Colvin, ADEC Division of Environmental Health at 555 Cordova St. Anchorage, AK 99501. Additionally, the ADEC will accept comments by facsimile at (907) 269-7510, by electronic mail at rebecca.colvin@alaska.gov, and on the DEC website using the comment link. The comments must be received not later than 11:59pm on September 22, 2020.

 

You may submit written questions relevant to the proposed action to Rebecca Colvin by email at rebecca.colvin@alaska.gov or at 555 Cordova St. Anchorage, AK 99501. The questions must be received at least 10 days before the end of the public comment period. The ADEC will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and at http://dec.alaska.gov/eh/solid-waste/.

After the public comment period ends, the ADEC will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected. Written comments received are public records and are subject to public inspection.
