The Alaska Department of Environmental Conservation (ADEC) has made a preliminary decision to approve Tesoro Alaska Company, LLC application for Air Quality Control Minor Permit AQ0035MSS09 for the Kenai Refinery. ADEC intends to incorporate the minor permit into the Title V operating permit as an administrative revision after EPA’s 45-day review, per 18 AAC 50.542(e).

Activity:
Tesoro Alaska Company, LLC’s application is classified under 18 AAC 50.508(6) to revise the oxygen (O2) operating limits for the Powerformer and Hydrocracker heaters, EU IDs 6 through 11, by clarifying and adding a new method for demonstrating compliance with the NOx Best Available Control Technology (BACT) limits during periods of planned startup, shutdown, and catalyst regeneration.
Emissions:
The permit action does not change potential emissions at the stationary source.

Based on review of the application, ADEC drafted a preliminary permit decision for this project under AS 46.14 and 18 AAC 50.

Opportunity for Public Participation:
Any interested person may present written statements relevant to the preliminary decision within 30 days after the first publication date. ADEC will consider all comments received and make any changes ADEC finds beneficial or necessary to assure compliance with 18 AAC 50 or state law. ADEC will issue a final decision to issue or deny the permit after the close of the public comment period. Any person may request a public hearing and that hearing will be held if ADEC finds that good cause exists.
