NOTICE OF PROPOSED VACATION OF A PORTION OF RIGHT OF WAY EASEMENT

NOTICE IS HEREBY GIVEN that the State of Alaska Department of Transportation and Public Facilities (the Department) proposes to vacate a small portion of the Old Tok Cutoff Highway right of way easement to Jay and Deborah Capps, the underlying property owners.

The parcel to be vacated is located on the west side of the highway near Slana at MP 61, adjacent to Midway Services. It is the outer 100’ of the 300’-wide (150’ each side of centerline) right of way easement, and is approximately 1.25 acres in size. The Department has determined that it is outside the roadway slope limits, is not needed for the roadway’s maintenance and /or operation, and is not needed for a public purpose.

This disposal of right of way by the Department is authorized by AS 19.05.070 and is guided procedurally under 17 AAC 10.100 through 17 AAC 10.105, and 17 AAC 10.125.

The physical file of the proposal is available for public inspection from 8:00 a.m. to 4:30 p.m., Monday through Friday, at the Department of Transportation and Public Facilities, Right of Way Section, 2720 Picket Place (west side of Peger Rd.), Fairbanks, Alaska. The Department will accept and review public comments regarding the proposed vacation (file CDV # 19-02-006). Comments must be made in writing and must be received no later than 4:30 p.m. on the projected closing date of Monday, February 24, 2020.
