Notice of Right-of-Way Lease Renewal and Amendment Application for the Nuiqsut Natural Gas Pipeline, ADL 416202

NOTICE OF RIGHT-OF-WAY LEASE RENEWAL AND AMENDMENT APPLICATION

FOR THE NUIQSUT NATURAL GAS PIPELINE, ADL 416202

The Alaska Department of Natural Resources (DNR), pursuant to Alaska Statute (AS) 38.35.070, hereby gives notice that on April 15, 2019, the North Slope Borough submitted an application under the provisions of 11 AAC 80.065 and AS 38.35 (Right of Way Leasing Act) to renew and amend the Nuiqsut Natural Gas Pipeline (NNGP) Right-of-Way (ROW) Lease, ADL 416202, for 20 years.

NNGP has a diameter of 3.5-inches and transports natural gas from the Alpine Central Processing Facility across both state and private lands to the city of Nuiqsut. NNGP shares vertical and horizontal support members with the Alpine Oil, Alpine Diesel and Alpine Utility pipelines for 8.8 miles to the Colville River crossing, at which point, the Alpine pipelines go east under the Colville River and the NNGP continues south belowground for the remaining 5.6 miles to Nuiqsut. The NNGP crosses approximately 2.4 miles of state land and encompasses 19.2 acres, more or less.

The NNGP ROW crosses state lands within the following townships within the Umiat Meridian:

 

Township 12 North, Range 5 East, Section 32;

Township 11 North, Range 5 East, Sections 5, 6, 7, and 18; and

Township 10 North, Range 5 East, Sections 17.

AS 38.35.200 governs judicial review of a decision of the Commissioner:

AS 38.35.200 Judicial review [of a decision of the commissioner].

(a) An applicant or competing applicant or a person who has direct financial interest affected by the lease who raises objections within 60 days of the publication of notice under AS 38.35.070 are the only persons with standing to seek judicial review of a decision of the commissioner under AS 38.35.100.

(b) The only grounds for judicial review of a decision of the commissioner are

(1) failure to follow the procedures set out in this chapter; or

(2) abuse of discretion so capricious, arbitrary, or confiscatory as to constitute a denial of due process.

Any objections pursuant to AS 38.35.200, must be submitted in writing to the address listed below by 5:00 p.m. on February 3, 2020.
