Notice of Petition Requesting Exemption from Economic Regulation

 

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that on November 6, 2018, Kipnuk Light Plant (KLP) filed a petition requesting exemption from economic regulation. KLP provides retail electric utility service in the village of Kipnuk. Kipnuk is 100 miles southwest of Bethel with a population of approximately 639 persons. Docket No. U-18-103 was opened to address this matter.

Economic regulation means regulation of matters concerning a utility’s rates and charges, quality of service, management practices, and customer complaints. KLP is requesting to be exempt from economic regulation which means the Commission would have no jurisdiction over these aspects of KLP’s electric utility service. The Commission has the authority to grant’s KLP’s request in its entirety, or in part.

KLP is owned and operated by the Kipnuk Traditional Council. KLP states the electric utilities in Rampart, Arctic Village, and Birch Creek are also owned and operated by their respective village councils and the Commission granted those electric utilities exemption from economic regulation. KLP is requesting similar treatment with this filing. KLP also states its staff struggles with the complicated filings required of an economically regulated utility and that being exempt would provide relief from this regulatory burden. Exemption from economic regulation will not exempt KLP from its obligations for participation in the power cost equalization program.
