Proposed Project and Location:

In accordance with the provisions of AS 38.05.850, the Department of Natural Resources, Division of Mining, Land and Water Southcentral Regional Office is considering issuance of a utility easement on State-owned, DNR-DMLW managed tide and submerged lands in Unga Strait near Sand Point, Alaska, within Sections 4 and 5, Township 56 South, Range 73 West, Seward Meridian.  The purpose of the project is to replace a failed sewer outfall pipe.

The proposed easement area is currently estimated to be 1,000 feet long by 30 feet wide, for a total area of 0.70 acres, more or less.  Please see attachment for additional location information.  Nothing herein implies the establishment of an easement across non-DMLW managed lands, even if such properties are depicted on project related maps, plans and drawings.

Members of the public and interested parties are invited to comment on this proposal. The Division of Mining, Land and Water must receive written comments addressed to DNR DMLW Southcentral Regional Office, 550 W. 7th Ave., Suite 900 C, Anchorage AK 99501-3577 no later than 5:00 pm on December 21, 2017.  Comments and questions may be submitted to the attention of Elizabeth Sherwood: telephone 907-269-7472, fax 907-269-8913, or elizabeth.sherwood@alaska.gov.

In order to be given full consideration, all comments should clearly explain the facts on which they are based and how they pertain to the proposed action. Following the comment deadline, all responses will be reviewed and the Department’s decision on this matter may be modified as a result of information received.  AS 38.05.850 is available on-line by conducting a search of the webpage at http://www.legis.state.ak.us/basis/statutes.asp.
