NOTICE OF FILING PETITION TO REMOVE THE RESTRICTION
ON AWU PAYING DIVIDENDS
The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that on November 9, 2017, the Municipality of Anchorage (MOA) d/b/a Anchorage Water and Wastewater Utility (AWWU), on behalf of Anchorage Water Utility (AWU) filed a Petition to Remove the Restriction on AWU Paying Dividends to the MOA. Docket No. U-17-095 was opened to address this matter.
AWU has been restricted from paying dividends to the MOA since the Alaska Public Utilities Commission (APUC) issued a By Direction Letter, dated September 18, 1980, in TA21-122. In the letter, the APUC stated the dividend restriction would be in place, “until such time as there is no erosion in the utility’s equity position because of the revenue shortfall resulting from the conditional approval of TA21-122.” The restriction on dividend payments has been in place since that time. AWWU in the petition, now states, “AWU’s capital is no longer impaired nor is expected to become impaired at any time in the foreseeable future, even with the payment of dividends having been restored.”
