Notice of Utility Tariff Filing

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that ENSTAR Natural Gas Company (ENSTAR) filed TA296-4, seeking Commission approval of an amendment to its Gas Sale and Purchase Agreement (GSA) between Alaska Pipeline Company (APLC) and Furie Operating, LLC (Furie). The Furie GSA was originally filed as TA282-4 and approved in Letter Order No. L1600193. APLC is the sister company of ENSTAR and owns the natural gas transmission pipeline that delivers gas to ENSTAR’s service area. Historically, the Commission has regulated ENSTAR and APLC as a single entity. 

Under the amended GSA, ENSTAR proposes to revise deadlines established in the original GSA. Specifically, the amended GSA extends the exercise date from April 1, 2018, to April 1, 2019, and extends the date by which Furie will achieve the conditions precedent set out in Section 13.3(b) of the original GSA from December 31, 2016, to July 31, 2018. Specifically, the condition that requires Furie to have at least three wells that can be used to produce the volumes of gas set out in the original agreement. Finally, ENSTAR is changing the deadline to submit the Reserves Report and Engineer’s Opinion Letter to October 31, 2018.

The amendment to the GSA confirms the pricing of the gas shall be according to Section 3.1(c) of the original approved agreement, which established the prices if Furie did not meet the conditions precedent. A comparison of the gas sales prices are as follows:
