NOTICE OF PROPOSED REGULATION CHANGES ON FEES IN THE REGULATIONS OF THE DEPARTMENT OF NATURAL RESOURCES - QUESTIONS AND ANSWERS AS OF JULY 7 2017

Question:
Please explain the footnotes 1-4 in the four column headings of the table of fee changes (Fee Matrix).  

Answer:
  The first footnote indicates that the “Services” listed in the first column are described in “General.” Those “Services” are described more specifically in the regulations themselves.

The second footnote indicates that the “Current Fees” listed in the second column are in 11 AAC 05.010.

The third footnote indicates the Estimated New Fees for 2018 to be set by a director’s order. These are anticipated to be initially less that the maximum fees (column 4), and gradually increased by the director’s over the following years to the limit of the maximum fees.

The fourth footnote indicates that the fees stated in the column are the fees set in the proposed regulation for the specified applications for resource use authorization or approval; the use of state-owned land, resource and interest; and fee for a facility use, publication, product, equipment or service.  These are the proposed maximum fees specified number of hours the department will be allowed to charge under these proposed regulations.  These fees do not include additional fees for staff time in excess of the hours specified for each type of application. If additional staff hours are required to adjudicate an application, the department may charge the applicant for the additional time at the hourly rate specified.


Question:
Please help me interpret the application of the Public or Private Easement or ROW line; it appears to be an application fee only.


Answer:  There are multiple proposed fees for a Public or Private Easement or Right-of-Way under proposed 11 AAC 05.070(c)(1).  Each of these address fees for just the application for each of the specified types of public or private easement or Right-of-Way.  Each of the proposed fees for the types of public or private easements or Rights-of-Way specify the limit of the number of staff hours that the applicant is entitled for adjudication of that application.  If additional staff hours are required to adjudicate that application, the department may charge the applicate for the additional time at the hourly rate specified under 11 AAC 05.070(c)(3).
           
If the application for a specified type of Public or Private Easement or Right-of-Way is approved, the land use fee under 11 AAC 05.070(c)(2) is also charged unless there is a one-time fee for the application and use specified.
