SUPPLEMENTAL NOTICE of Proposed Changes: Medicaid Rate Setting Methodology for Personal Care Services and Home & Community- Based Waiver Services

SUPPLEMENTAL NOTICE OF PROPOSED CHANGES TO MEDICAID RATE SETTING METHODOLOGY FOR PERSONAL CARE AND HOME & COMMUNITY-BASED WAIVER SERVICES IN THE REGULATIONS OF THE DEPARTMENT OF HEALTH & SOCIAL SERVICES

BRIEF DESCRIPTION

The Department of Health & Social Services proposes to change regulations on Medicaid rate setting methodology for personal care and home and community-based waiver services to comply with federal regulations. The purpose of the proposed changes is to comply with federal regulations concerning conflict-free management. The proposed changes include adopting a new rate setting methodology that aligns with program changes for person-centered care coordination services in Alaska. Furthermore, the proposed changes make substantial refinements to rate setting methodologies for other Medicaid personal care and home and community-based waiver services to reduce administrative burden, produce accurate Medicaid rates for reimbursement, and ensure predictability.

The Department of Health & Social Services proposes to adopt regulation changes in 7 AAC of the Alaska Administrative Code, dealing with Medicaid rate setting methodology for personal care and home and community-based waiver services, 7 AAC 145.500 – .537.

This is a SUPPLEMENTAL NOTICE adding to the NOTICE OF PROPOSED CHANGES that was issued on September 12, 2016, concerning these proposed regulation revisions contained in the Department of Law file number JU2016200226. This SUPPLEMENTAL NOTICE is being issued because the Department of Health & Social Services has decided to extend the deadline for public comments to December 9, 2016.

You may comment on the proposed regulation changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to the Department of Health & Social Services, Office of Rate Review, Attn: Kate Tompkins, 3601 C Street, Suite 978, Anchorage, Alaska 99503. Additionally, the Department of Health and Social Services will accept comments by facsimile at (907) 334-2220 and by electronic mail at katherine.tompkins@alaska.gov . The comments must be received not later than 5 p.m., on December 9, 2016.

You may submit written questions relevant to the proposed action to Kate Tompkins by email at katherine.tompkins@alaska.gov and the physical address listed above. The questions must be received at least 10 days before the end of the public comment period. The Department of Health & Social Services will aggregate its response to substantially similar questions and make the questions and responses available on the Alaska Online Public Notice System and http://dhss.alaska.gov/Commissioner/Pages/RateReview/default.aspx.

After the public comment period ends, the Department of Health & Social Services will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected.
