Notice of Request for an Adjudicatory Hearing Regarding Septic System Separation Distances

Background:
The ADEC, Water Division, Wastewater Discharge Program responded to a complaint that a single-family residential wastewater disposal system (WWDS) installed in the Paradise Park Subdivision did not have adequate separation distance from a water body as required by Alaska law and as shown on the Plat for the Subdivision. Wastewater Discharge Program staff visited the site and determined that the separation distance requirements had been satisfied. The requester disagrees with the Water Division’s determination.

As provided in 18 AAC 15.220 any person who wishes to file a response to the request for adjudicatory hearing must do so by serving a response on the Office of the Commissioner, Department of Environmental Conservation by September 29, 2016. Written responses may be served by mail addressed to Gary Mendivil, Hearing Liaison, Office of the Commissioner, Department of Environmental Conservation, Post Office Box 111800, Juneau, AK 99811-1800, by facsimile to (907) 465-5070, or by e-mail to Gary.Mendivil@alaska.gov

The Commissioner or his designee will issue a decision on the request for adjudicatory hearing pursuant to 18 AAC 15.220.
