NOTICE OF FILING OF PETITION FOR LEGISLATIVE REVIEW ANNEXATION TO THE CITY OF MANOKOTAK AND SUPPLEMENTAL NOTICE OF FILING OF PETITION FOR LEGISLATIVE REVIEW ANNEXATION TO THE CITY OF DILLINGHAM

The City of Manokotak (Petitioner), a second class city in the unorganized borough, has filed a petition with the Local Boundary Commission (LBC) to annex territory by the legislative review method. The territory proposed for annexation consists of land and water on the west side of Nushagak Bay. It is composedof three parts, generally described as: uplands and river corridor from the city’s southeastern border to the mouth of the Snake River; the Snake River and Igushik Sections of the Nushagak Commercial Salmon District; and coastal uplands in the vicinity of Igushik Village from the mouth of the Igushik River south to Nichols Spit. The current size of the city is 36 square miles; the territory proposed for annexation is 154.7 square miles of land and water.

The LBC postponed proceedings on a petition by the City of Dillingham to annex Nushagak Bay in order to allow concurrent consideration of this Manokotak annexation petition. The LBC chair has consolidated the two petitions so that they will now proceed on the same schedule and be considered concurrently.

Standards governing annexation to cities are set out in AS 29.06.040-060, 3 AAC 110.090-140, and 3 AAC 110.900-990. Procedures for city annexation are in AS 29.06.040 and 3 AAC 110.400-700.

The representative of the petition to expand the City of Manokotak’s boundaries is Manokotak Mayor Melvin Andrew. The petition and related documents, including a map of the territory proposed for annexation, will be available for public review at the following locations, days, and times:

Any interested person may file written comments with the LBC regarding the two concurrent annexation petitions: Manokotak’s and Dillingham’s. Additionally, a person with the capacity to sue may file with the LBC a responsive brief supporting or opposing the petitions. Public comments and responsive briefs must be filed in accordance with 3 AAC 110.480 and 3 AAC 110.700. A person who files a responsive brief (as opposed to written comments) gains certain procedural rights and duties during the petition proceedings. Inquiries may be directed to LBC staff whose contact information is listed below. The deadline to file responsive briefs and written comments for the Dillingham annexation petition has been extended. The deadline for filing responsive briefs and written comments for both the Manokotak annexation petition and the Dillingham annexation petition with the LBC is 4:30 p.m., February 26, 2016, at the address, fax, and email below.

Commenters must either send a copy of the comments to the respective petitioner(s) and file a statement indicating that submission, or notify the department of an inability to send comments to the petitioner(s). Comments can be sent to the petitioners at:

After the petitioner has an opportunity to answer any responsive briefs and comments, the Alaska Department of Commerce, Community, and Economic Development (Commerce) will prepare a preliminary report on the proposals. Following receipt and consideration of comments on the preliminary report, Commerce will issue its final report. The LBC will then hold at least one local public hearing on the proposals. If approved by the LBC, the annexation(s) will be submitted during the first 10 days of a regular session of the Legislature. If the petition(s) is not disapproved by the Legislature, it takes effect 45 days after submission.
