Notice of Utility Tariff Filing

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that Alaska Pacific Environmental Services Nome, LLC d/b/a Pacific Waste (APES-Nome) filed tariff revision TA23-655, proposing to clarify, modify, or correct certain definitions and rules in its tariff. Some examples of the proposed tariff revisions are listed below: 

  • Deposit provisions at Rule 200.20.3 have been revised from requiring the utility to refund deposit after one year to requiring a refund after twelve consecutive months of timely payments. Rule 200.50.12, a provision that requires an advance payment to reinstate service after it has been cancelled for nonpayment, was also revised to state twelve consecutive months of timely payments.
  • Rule 200.50.1 has been revised from “payment is due within fifteen days of billing date” to “[p]ayment is due as of the billing date”.
  • The length of time before an account is considered past due, stated at Rule 200.50.8, has been changed from 45 days to 25 days.
  • A new provision allowing APES-Nome to render make-up bills within six months of service has been introduced as Rule 200.50.17.
  • A provision specifying that it is the customer’s responsibility to verify the utility billing, and that charges are binding unless objected to within six months of billing, has been introduced as Rule 200.50.18.
  • Vacation credit provisions at Rule 200.50.7 have been changed to limit a vacation credit period to two months.
  • Rule 200.70.1 governing Customer Provided Equipment (CPE), has been revised to add specifications for CPEs. In addition, the utility will bear any repair or replacement costs of CPE for failure of the utility to exercise reasonable care.
  • The mailing address for written informal customer complaint stated at Rule 200.80.1 has been changed to 3301 C Street, Suite 209, Anchorage, AK from 120 East First Avenue, Nome, AK.
  • The provision related to Termination of Service by the Utility (See Rule 200.140.1) was modified to add two additional grounds for termination: (1) failure on the part of the customer to observe the rules and regulations of the company; and (2) the use of profane or obscene language, reasonably to be expected to frighten, abuse, torment or harass utility personnel.
