Regulations dealing with administrative procedures were adopted by the Department of Environmental Conservation on September 29, 2017, with an effective date of November 7, 2017. The regulations have been made permanent and have been filed by the Lt. Governor. The regulations will appear in Register 224, January 2018, of the Alaska Administrative Code. The regulations changes are summarized as follows:

The administrative procedure regulations have been amended to clarify and update as well as eliminate conflicts with similar regulations under the Office of Administrative Hearings. Given the complex technical nature of many of the department’s decisions, the procedures outlined in these amendments ensure that due process is protected and that the involved parties have the opportunity to address the issues in a clear and efficient manner. Changes were made to many other regulations under the department’s authority in order to conform to these amendments. The regulations were also updated to allow for electronic mail and sharing of electronic documents.
