RIGHT-OF-WAY LEASE APPLICATIONS

The Commissioner of the Department of Natural Resources (DNR), pursuant to Alaska Statute (AS) 38.35.070, hereby gives notice that Harvest Alaska, LLC (Harvest) submitted two right-of-way lease applications, in accordance with the Alaska Right-of-Way Leasing Act, AS 38.35.050, for pipelines associated with the proposed Liberty Project.
The pipelines would originate at the proposed man-made Liberty Island in federal waters off the North Slope, then cross approximately 5.6 miles of Foggy Island Bay in the Beaufort Sea and 1.5 miles of State-owned uplands. The State right-of-way would include roughly 4.5 miles subsea and 1.5 miles of uplands, terminating at the connection to the Badami Pipelines. The DNR rights-of-way will only authorize the pipelines on State of Alaska lands.
The Liberty pipelines would be buried subsea in a 16” pipe which will contain the two smaller-diameter pipelines. A 12” pipeline will transport sales oil, and a 4” pipeline will transport natural gas to the island or be used as backup for the oil line. The pipelines will separate once ashore and will be installed on the same set of vertical support members (VSMs).
The pipeline design maximum throughput is 70,000 barrels per day for the sales oil line and 20 million standard cubic feet per day of natural gas for the utility gas line. Fiber-optic and cathodic protection measures will be installed with the pipelines.
Harvest has requested 400-foot-wide onshore and 1,500-foot-wide offshore rights-of-way for pipeline construction, and 50-foot-wide onshore and 200-foot-wide offshore permanent rights-of-way for operations. Additional construction right-of-way areas include lands for pipe storage and temporary staging.

Copies of the application are available at the Anchorage, Fairbanks, Utqiagvik, Kaktovik, and Nuiqsut libraries.
AS 38.35.200 governs judicial review of a decision of the Commissioner:

An applicant or competing applicant or a person who has direct financial interest affected by the lease who raises objections within 60 days of the publication of notice under AS 38.35.070 are the only persons with standing to seek judicial review of a decision of the commissioner under AS 38.35.100.

The only grounds for judicial review of a decision of the commissioner are

failure to follow the procedures set out in this chapter; or
-
abuse of discretion so capricious, arbitrary, or confiscatory as to constitute a denial of due process.
Any objections pursuant to 38.35.200 must be submitted in writing to the address below by 5:00 p.m. on November 6, 2017.
