Preliminary Decision for Easement to AEL&P for Sheep Creek Transmission Line

NOTICE OF PROPOSED EASEMENT
ADL 108448
to Alaska Electric Light & Power Co.

In accordance with AS 38.05.035, the Division of Mining, Land and Water (DMLW) has issued a preliminary decision to authorize a 30-year private non-exclusive easement to Alaska Electric Light & Power Co.  (“Applicant”) for approximately 12.5 acres of state-owned uplands located in Sheep Creek Valley, approximately 4 miles south of downtown Juneau for the maintenance of an existing electric transmission line.  The transmission line is related to the existing Annex Creek hydropower facility and FERC power project 2307.  

The subject lands are in Sections 32, 33, 34, Township 41 South, Range 68 East, Copper River Meridian.

Public notice of the preliminary written decisions and the associated documents will be posted on the Alaska Public Notice System website for 30 calendar days (http://notice.alaska.gov). The public may provide written comments to DMLW during that time. Additionally, notice of the preliminary decision will be given to adjacent landowners. The Juneau post offices will also be requested to post the notice of the preliminary decision.

The public is invited to comment on the preliminary decision. Written comments must be received by DNR no later than 5:00 p.m. on August 21, 2017. All comments must be submitted to: DNR, Division of Mining, Land and Water, Southeastern Regional Office by mail at 400 Willoughby Avenue, P.O. Box 111020, Juneau, AK 99811-1020, by fax at 907-465-3886, or by electronic mail to adam.moser@alaska.gov to ensure consideration. Please include your mailing address and telephone contact.  DNR reserves the right to issue additional public notice as it determines necessary.

Following the close of the comment period, all timely written comments will be considered, and DNR may make appropriate revisions to the decision or issue the preliminary decision as a final written decision. A copy of the final decision will be sent to all persons who comment on the preliminary decision. Persons who are aggrieved by the final decision will have the right to appeal it.

The Division of Mining, Land and Water reserves the right to waive technical defects in this publication.
