Water Quality Standards: SUPPLEMENTAL NOTICE of Proposed Changes in the Regulations dealing with the Standard Analytical Methods used to Measure Compliance with Water Quality Standards & Wastewater Effluent Limits

 

BRIEF DESCRIPTION

The Alaska Department of Environmental Conservation (DEC), Division of Water proposes to amend regulations in Title 18, Chapters 70 and  83 of the Alaska Administrative Code by updating the standard analytical methods DEC uses to measure compliance with Alaska water quality standards and wastewater permit effluent limits.

 

DEC proposes toadopt regulation changes in Title 18, Chapter 70 and 83 of the AlaskaAdministrative Code, dealing with Water Quality Standards, including thefollowing:

 

(1)        amend Notes 1, 9, and10 to the Water Quality Standards Table in 18 AAC 70.020(b) by revising provisionspertaining to methodology and by adopting updated published versions of regulatoryinformation previously adopted by reference;

 

(2)        amend 18 AAC70.020(c)(1) – (3) by adopting updated published versions of the regulatoryinformation previously adopted by reference;

 

(3)        amend 18 AAC 70.030(a) byadopting updated published versions of the regulatory information previouslyadopted by reference; and

 

(4)        amend 18 AAC 83.010(f)by adopting the updated published version of Code of Federal Regulations previouslyadopted by reference.

 

This is a SUPPLEMENTALNOTICE containing information pertinent to the NOTICE OF PROPOSED CHANGES thatwas originally issued on January 13, 2015, concerning the proposed regulatoryrevisions. This SUPPLEMENTAL NOTICE is being issued to clarify the descriptionof the proposed regulatory changes and because the original notice did notinclude the invitation to submit written questions regarding the proposed changesat least 10 days before the end of the public comment period, if a commenterwished to facilitate a response on a question from DEC before the close of thecomment period.

 

You may comment on theproposed regulation changes, including the potential costs to private personsof complying with the proposed changes, by submitting written comments toDenise Elston, DEC Division of Water, at 410 Willoughby Ave, Suite 303, P.O.Box 11800, Juneau, Alaska 99811. Additionally, DEC will accept comments byfacsimile at (907) 465-5274 and by electronic mail at denise.elston@alaska.gov. Comments may also besubmitted through the Alaska Online Public Notice System, by accessing thisnotice on the system and using the "comment" link.  The comments must be received no later than5:00 p.m. on March 10, 2015.

 

Oral or written comments also may be submitted at ahearing to be held on Wednesday February 25, 2015, in the DEC Main ConferenceRoom, Second Floor, 410 Willoughby Avenue, Juneau. The hearing will be heldfrom 4:00 p.m. to 6:00 p.m. and might be extended to accommodate those presentbefore 6:00 p.m. who did not have an opportunity to comment. Those individualswho cannot attend the public hearing but wish to participate via teleconferencemay do so by calling (800) 315-6338. Access Code 51851.

 

You may submit written questions relevant to theproposed action to Denise Elston by electronic mail at denise.elston@alaska.gov or 410 Willoughby Ave,Suite 303, P.O. Box 11800, Juneau, Alaska 99811. The questions must be receivedat least 10 days before the end of the public comment period. DEC will aggregateits response to substantially similar questions and make the questions andresponse available on http://dec.alaska.gov/Water/wqsar/wqs/analytical_methods_updates.htm.  DEC may, but is not required to, answerwritten questions received after the 10-day cut-off date and before the end ofthe comment period.

After the public comment period ends, DEC willeither adopt the proposed regulation changes or other provisions dealing withthe same subject, without further notice, or decide to take no action.  The language of the final regulations may bedifferent from that of the proposed regulations.  Youshould comment during the time allowed if your interests could be affected.  Written comments received are publicrecords and are subject to public inspection.
